Lawsuit Filed Against City of Summersville and Officials
A Summersville resident has filed a lawsuit against the City, its Mayor and a Police Officer.
The lawsuit was filed by Summersville attorney Larry Losch on behalf of Shelley Stubbs in Nicholas County Circuit Court. Stubbs claims that after making a complaint to Mayor Robert Shafer outside Patty's Video Gaming establishment in Summersville, she was told she was banned from Patty's because the Mayor had indicated if Stubbs was allowed to continue to patronize the establishment, he would no longer go to Patty's because of the verbal harassment he was receiving from her.
In the lawsuit, Stubbs claims that her being banned from the establishment was unlawful and a violation of her civil rights. Stubbs also claims Summersville Police Officer Jason Lanham confronted her in a church parking lot. She claims a false arrest took place when a letter banning her from the establishment was given to her in the parking lot because she was unable to leave on her own free will.
Stubbs is asking for unspecified monetary damages. The case is scheduled to be heard in Nicholas County Circuit Court in October of 2010.
